Plaintiffs filing da Vinci lawsuits allege that the arms of the machine are not insulated properly and that the electrical current may jump around, thus burning nearby healthy organs and tissues. Additionally, according to the Wall Street Journal in an article posted May 25, 2010, some physicians maintain that Intuitive did not provide adequate training to the hospitals and surgeons using the device. When a hospital agrees to purchase the da Vinci Surgical System, Intuitive pays for a two-day course to properly train two physicians in the use of the device. While some hospitals have taken it upon themselves to establish thorough training programs, other facilities may not require supervision or full training to operate the robot. However, Intuitive maintains that they did not engage in improper training to encourage the implementation of its product.

Alleged Injuries from the da Vinci Surgical System

Plaintiffs injured by the da Vinci robot allege that patients may face serious complications following their surgeries that may have been avoided as a result of design flaws and inadequate training, including:

  • Excessive bleeding
  • Burning or tearing of organs and intestines
  • Inflammation of the lining in the abdomen
  • Punctured arteries, vessels or organs
  • Revision surgeries
  • Wrongful death

FDA Attempts to Learn More

According to allegations, Intuitive Surgical did not properly test the device before they placed it on the market. Additionally, plaintiffs claim that the manufacturer did not evaluate the long-term consequences and may have withheld information regarding complications or injuries post-surgery.

However, the U.S. Food and Drug Administration (FDA) issued a survey to gain additional information from surgeons regarding their opinions after noticing an increase in complications stemming from the use of the device. Additionally, in May 2013, Intuitive sent a notification to hospitals warning surgeons of the potential complications and risks associated with the cautery scissors. According to CNBC, the scissors may develop cracks that can lead to an inadvertent leaking of energy and burning of the nearby tissues.
